1.3 PURPOSES AND LEGAL BASIS OF PROCESSING

Personal data as per Art. 4 No. 1 GDPR includes all information relating to an identified or identifiable natural person. This includes details such as name, postal address, email address, phone number, as well as information that arises necessarily during the business relationship, like details about the start, end, and scope of services and products.

We process your personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG) if necessary for establishing, performing, or fulfilling a contract, as well as implementing pre-contractual measures. If personal data is necessary for initiating or conducting a contractual relationship or for implementing pre-contractual measures, processing is lawful according to Art. 6 Par. 1 lit. b GDPR.

If you grant us explicit consent to process personal data for specific purposes (e.g., sharing with third parties, analysis for marketing purposes or promotional email outreach), the lawfulness of this processing based on your consent is given according to Art. 6 Par. 1 lit. a GDPR. If necessary and legally permissible, we process your data beyond the actual contractual purposes to fulfill legal obligations according to Art. 6 Par. 1 lit. c GDPR. Furthermore, processing might occur to safeguard legitimate interests of ours or third parties and to defend or assert legal claims as per Art. 6 Par. 1 lit. f GDPR. As a data subject, you have the following rights under the General Data Protection Regulation (GDPR), provided their respective legal requirements are met:

Case-specific Right to Object
You have the right, for reasons arising from your specific situation, to object at any time to the processing of your personal data based on Art. 6 Para. 1 S. 1 e) GDPR or Art. 6 Para. 1 S. 1 f) GDPR. This also applies to profiling based on these provisions. We will then no longer process these personal data for these purposes, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.

Right to Object to Data Processing for Direct Marketing Purposes
In individual cases, we process your data for direct marketing purposes. You have the right to object at any time to the processing of personal data concerning you for such advertising. This also applies to profiling, insofar as it is associated with such direct advertising. Rectification
According to Art. 16 GDPR, you can obtain the rectification of inaccurate personal data concerning you. Furthermore, you can obtain the completion of incomplete personal data.

According to Art. 17 GDPR, you can request the deletion of your personal data stored by us, unless the processing is necessary for exercising the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims.

According to Art. 7 Para. 3 GDPR, if you gave your consent to the processing of your personal data you can withdraw your consent at any time with future effect. The lawfulness of the processing of your personal data until your withdrawal will not be affected.

Right of appeal
According to Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence, workplace, or our company headquarters.

1.5 RECIPIENTS OF PERSONAL DATA

We share your personal data within our company only with departments and individuals who need this data to fulfill contractual and legal obligations or to implement our legitimate interests.

Your personal data may be transferred to affiliated companies, as far as this is permissible under the purposes and legal bases outlined in No. 1.3 of these privacy notes.

Your personal data will be processed on our behalf based on data processing contracts as per Art. 28 GDPR. In these cases, we ensure that the processing of personal data is in line with the provisions of the GDPR. The categories of recipients in this case are internet service providers and customer management system and software providers.

Data transfer to recipients outside the company is only done if allowed or required by law, if necessary for contract initiation or fulfillment, if required for pre-contractual measures on your request, if we have your consent, or if we are authorized to provide information. Under these conditions, recipients of personal data can be, for example:

  • External tax consultant
  • Public bodies and institutions (e.g., public prosecutor's office, police, supervisory authorities, tax office) if there's a legal or official obligation
  • Recipients to whom sharing is directly necessary for contract initiation or fulfillment, such as transport service providers, subcontractors, and cooperation partners.

1.6  CREDIT CHECKS

As part of our business activities, we conduct credit checks to minimize risk and protect against defaults. These checks are based on the processing of necessary personal data in strict compliance with the General Data Protection Regulation (GDPR). We collect and process this information solely for the purpose of assessing the creditworthiness of our clients, relying on our legitimate interest as the legal basis. Your data is processed only to the extent absolutely necessary for conducting these checks. 1.7  TRANSFER TO A THIRD COUNTRY

Your personal data will only be transferred outside the European Economic Area if it is necessary for contract fulfillment, upon your explicit request, or for legal reasons. In these cases, we ensure that appropriate data protection measures are taken in accordance with EU standard contractual clauses to adequately protect your data.

As necessary, we process and store your personal data for the duration of our business relationship or for fulfilling contractual purposes or – in the case of consent – as long as you have not revoked the consent. This includes, among other things, the initiation and execution of a contract.

In addition, we are subject to various retention and documentation obligations that arise, among other things, from the Commercial Code (HGB) and the Tax Code (AO). The prescribed retention or documentation periods range from two to ten years.

2. Data Processing on the Website

2.1 Own services

a) Duration of Storage of Log Files

When you visit our web pages, we temporarily record various pieces of information in a log file for security purposes. This includes the name and URL of the web page you accessed, the date and time of your access, the amount of data transferred during your visit, the type and version of your browser, the operating system you used, the URL of the website you visited before ours (referrer URL), your IP address, and the identity of your internet service provider. Storage Period and Justification

The log files are retained for a period of 2 months. This duration is carefully chosen to balance security needs and privacy rights. Post this period, the logs are deleted unless they are needed for legal investigations.

b) Hosting

All data related to the operation of this website are stored as part of hosting services. This is necessary to enable continuous operation of the website. The data is processed based on our legitimate interests according to Art. 6 Para. 1 f) GDPR. We use web hosting provider services to whom the above-mentioned data is transmitted.

c) Newsletter Subscription

To provide regular information about our company and offers, we offer a newsletter service. When you register for our newsletter, we will send you a confirmation link to the email address you have provided. Only after you have activated the link will you receive our newsletter (double opt-in). By subscribing to the newsletter, you consent to use your data (email address and other voluntary information) for this purpose under Art. 6 Para. 1 a) GDPR.

2.2 Third-Party Services

We use external dynamic content to optimize the presentation and offerings of our website. A connection to the servers of the respective third-party providers is established only when you click on the corresponding buttons. This involves a request to the server of the respective content provider, transmitting certain log data (e.g., the user's IP address), while the dynamic content is transmitted to and displayed on our website. a) Google Maps

We use the "Google Maps" map service from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, on our website to provide an interactive map. When displaying the map, data, including your IP address and location, are transmitted to and stored on Google's servers in the USA. We do not have precise knowledge about the content of the transmitted data or its use by Google. We use link buttons to our company pages on social media networks such as Facebook, YouTube, LinkedIn, and Xing on our website, based on Art. 6 Para. 1 S. 1 lit. f GDPR, to increase awareness of our operation. The underlying advertising purpose is considered a legitimate interest in terms of the GDPR.

a) Facebook Fanpage

We utilize our Facebook Fan Page for communication, customer engagement, and interaction. In doing so, we collect and process your data to respond to inquiries, receive feedback, and improve the content offered on our page. We share this responsibility with Meta Platforms Ireland Limited, 4 Grand Canal Square Dublin 2, Ireland, in accordance with Article 26 of the GDPR. The legal basis for this processing is Art. 6 Para. 1 S. 1 lit. F GDPR. Our legitimate interest lies in communicating with you and facilitating a quick and easy contact via our Facebook Fan Page.

Data Usage and Insights
Regarding the jointly responsible service of Page Insights, we only receive statistical usage data. The processed categories of personal data may include age, gender, interests, city, language, and potentially other information you provide.

As Meta acts as a data processor on behalf of SETEX in this context, the data processing requirements of Article 28 GDPR are met. These terms also contain additional provisions for the processing of personal information, complying with Article 28 GDPR requirements and covering all scenarios where Meta Platforms Ireland Ltd. acts as a data processor.

Internal Data Sharing and Third-Country Data Transfer
Your personal data is only shared with internal departments of SETEX as necessary for the pursued purposes. For information on the recipients of the data among the jointly responsible parties, please refer to their privacy notices.

We do not transfer your data to a third country. However, it should be noted that the jointly responsible Meta Inc. may transfer data to Meta Platforms Inc., Meta Headquarters, 471 Emerson St., Palo Alto, CA 94301-160, USA, which constitutes a transfer to a third country without an adequacy decision. Data Retention Periods
Unless there are legal retention obligations, personal data will be deleted after the direct communication has been fully responded to, or after the removal of the comment in question, but no later than the termination of the usage relationship. b) YouTube

Our YouTube channel SETEX Textile Automation Technology contains videos and content offered on the platform of YouTube, a service of Google Ireland Limited. When you visit our channel or view videos, your personal data is processed. We would like to inform you about the type, scope, and purpose of data collection and use concerning your visit to our YouTube channel.

Contact and interaction via the YouTube channel: We process your personal data when you contact us via our channel. The information you provide, as well as your YouTube profile, are visible to us. Additionally, we may process the following information:

Statistical evaluation: We use YouTube statistics and history to tailor our offerings to your needs, optimize user behavior, and improve video design. The generated statistics are anonymized and provide information about the number of users, interactions, and timing of visits to our page. The legal basis for this processing is Art. 6 Para. 1 lit. f GDPR. Our legitimate interest is to improve our YouTube offering. We only transfer your personal data to internal SETEX departments as necessary for the above purposes. Google processes the data as the operator of YouTube as described in the privacy notices. We store your personal data only as long as necessary for the above purposes. In the event of an objection, we delete your data unless further processing is legally allowed. c) LinkedIn

This chapter provides insights into how we process your personal data when you visit our LinkedIn profile SETEX Schermuly textile computer GmbH.

Data Processing Purpose
Our main purpose in processing your personal data on our LinkedIn profile is to enable meaningful interactions with you. This includes responding to your inquiries, fostering discussions, and sharing relevant information about automation in textile finishing. Joint responsibility
LinkedIn jointly controls the personal data of members who visit company pages, including our page, with the page administrators on LinkedIn. There is a Joint Controllership Addendum in place between LinkedIn and Administrators. This Addendum clearly outlines the roles and responsibilities of the parties with respect to personal data derived from company pages.

LinkedIn processes data that members provide on their profiles, such as job function, country, industry, seniority, company size, and employment status data. In addition, LinkedIn processes information on how a member has interacted with a company page, for example, whether a member is a follower. This data is aggregated and provided to Administrators as ‘Page Insights.’ These insights assist Administrators in better understanding the trends and demographics of those who interact with their company page. It is important to note that members are not identifiable from the aggregate data provided to the Administrator.

The Addendum mandates that both LinkedIn and Administrators comply with their obligations under the General Data Protection Regulation (GDPR). This includes upholding data subject rights and responding to data subject requests.

Data security and transparency
LinkedIn takes data protection seriously. They have conducted a Transfer Impact Assessment (TIA) for data transfers to the United States and adhere to strict guidelines for processing government requests for data disclosure according to their guidelines for law enforcement requests.

Cross-border data transfers
LinkedIn Ireland may transfer personal data processed within the European Union to its processor in the United States, LinkedIn Corporation. We process your personal data for the following purposes:

  • Contact and Interaction: We process your personal data when you contact us via Xing. The data provided during your contact and interaction via Xing, as well as your Xing profile, are visible to us. We process data such as the date and time of interaction, type of device used, possibly used operating system, type and content of the interaction (e.g., direct messages, comments), profile name, profile picture, and any other information you provide. We collect and process your personal data to respond to your inquiries, to publish current job offers, and to report on current topics in textile finishing automation. Xing itself uses the data to create analyses, evaluations, and statistics.
    The legal basis for this processing is Article 6(1)(f) of the GDPR, as our legitimate interest lies in communicating with you and providing information about current topics in plant and mechanical engineering. The SETEX Service Platform "mySETEX" allows registered users to access detailed information, software downloads, and machine integration.
